  1. NO PURCHASE NECESSARY.
    Participants must be 18 years of age or older at time of entry. The NASCAR.COM Draft and Play game (the "Game") is open to legal residents of the 50 United States and the District of Columbia. Employees of Turner Sports Interactive, Inc. ("TSI"), National Association for Stock Car Auto Racing, Inc. ("NASCAR") and its drivers, teams and properties, Sports Enthusiast Media LLC dba Head2Head Sports, and each of their respective parents, affiliates, subsidiaries, agents or representatives' employees, dealers or retailers, advertising or promotion agencies (collectively the "Game Entities") are not eligible to win any prizes, nor are members of Game Entities' families or households. TSI is the sponsor of the Game ("Sponsor"). Head2Head Sports is the "Game Administrator." By entering the Game, participants agree to accept and be bound by all terms of these Official Rules and Regulations. Game is subject to all federal, state and local laws and regulations. Game may not be used in connection with any form of gambling. Void where prohibited or restricted by law. By entering the Game, participants agree to provide certain personally identifiable information to TSI which shall become the property of TSI for the benefit of NASCAR. Please review the TSI privacy policy located at http://www.nascar.com/guides/about/privacy.html to see how TSI treats personally identifiable information.
  2. HOW TO ENTER/PLAY/WIN.
    There is no purchase necessary or a fee to register. NASCAR.COM will conduct a Game in tandem with the 2008 Sprint NASCAR season (the "Season"). Access the NASCAR website at http://fantasy.nascar.com and follow the instructions to register for the Game. Read and follow the How to Play. Game registration begins January 24, 2008, 5:00 PM Eastern Time ("ET") and ends November 16, 2008, one (1) hour prior to the start of the last NASCAR Sprint Cup Race (the "Race") (the "Game Period"). The term in which points are accumulated is up until one (1) hour after to the end of the last weekly Race on November 16, 2008. Winners will be determined on or about November 18, 2008. All entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) who is responsible for assigning email addresses for the domain associated with the submitted email address. Any participant who attempts to enter with multiple email addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. Limit four (4) entries per person. All entries become the property of Sponsor and will not be returned. False or deceptive entries or acts will render the participant ineligible.

    To enter DRAFT AND PLAY FANTASY NASCAR (the "Contest") via the Contest website, click the appropriate navigational link on the Contest website, agree to abide by the official rules governing the Contest, then follow the instructions to submit your entry, which includes selecting your team name, league, and draft time. Upon successfully submitting your entry, you will receive confirmation via email your user ID and password to be used for participating in your league's online draft and modifying your team as well as accessing results.
  3. DEADLINE.
    The Game begins on Sunday, February 17, 2008, and ends on Sunday, November 16, 2008, spanning the NASCAR season and 36 races. In the event that a race is postponed until after November 16, it will be removed from the Contest.

    You may still participate in the Game and draft after Sunday, February 17, 2008. Each week, beginning Monday, February 18, teams in leagues that successfully complete their draft prior to the start of the weekend's race will begin accumulating points from that weekend's race. Points from previous races will not be used for late-drafting leagues. Live stats (optional package) will provide unofficial point totals until the final posting of results.
  4. LEAGUE FORMATION. All leagues will consist of eight teams. At the time of signup, you will determine how you wish to compete in the Game by specifying your league option (public or private).
    League Options
    You may choose one of three league options:
    1. Join a Public League
    2. Join a Private League
    3. Create a Private League


    Join a Public League
    You may choose to join a public league, and you will be grouped with seven other team owners who select the same draft time. You will be placed in a queue and assigned the next available draft league and time. Notification of your draft will be posted on the website for your team. All public leagues will use the automated draft engine to select their teams. A live draft room is not available for a public league.

    If a public league does not have 8 teams registered 1 hour prior to its draft time, the league will be dissolved. Team owners in the dissolved league will be notified, and placed in a new public league if one is available. For additional information regarding this, please refer to the CHANGE LEAGUE section of the rules.

    Join a Private League
    In order to join an existing private league, you must have been invited to join the league and provided with a unique league password. This unique league password is required during the signup process.

    Create a Private League
    You may also choose to create a new private league and invite up to seven other team owners to join your league. If you are unable to fill your private league with seven additional teams, you may open it to the public once your friends have registered.

    Your private league must have eight teams registered before play can begin, or it will be dissolved. You will have until one hour before your draft time to have all eight teams registered. A private league has the option to choose the automated draft or live draft option.

    Once eight teams have registered for your league regardless of its type (public or private), the league and draft time are locked, and you no longer may change leagues nor draft times.

    Change League
    The CHANGE LEAGUE option allows you to withdraw from your current league and enter a different league and draft time. You may change your league provided that your current league does not have 8 teams registered, and thus is not yet locked.

    In addition, the CHANGE LEAGUE option allows team owners who have created a private league to change the time of their league's draft, if another time is available. Note that any change to a draft time must be done no later than ONE HOUR prior to the draft time. Finally the CHANGE LEAGUE option allows team owners who have created a private league to change the status of their league from private to public in order to fill the league.
  5. DRAFTING YOUR TEAM.
    During your league's draft, you will draft your initial roster of 6 Sprint Cup drivers using a pre-determined, random-generated draft order for your league and a snake-order format. This random draft order will be available in the live draft room (private leagues only) one hour prior to the start of the draft. Once a driver has been selected, he is removed from the pool of available drivers and no other team in your league may select him. Your team must consist of four drivers on your starting team and 2 drivers in your garage. These drivers remain on your team until you decide to modify your team. For additional information, please refer to the MODIFY TEAM section of the rules.

    Starting Team
    Your starting team must consist of 4 Sprint Cup drivers. Garage - Your garage must consist of 2 Sprint Cup drivers.

    Listed and Unlisted Drivers
    You can select any available listed driver during your league's draft. Listed drivers may be selected for your starting team and for your garage. You cannot select an unlisted driver during your league's draft.

    Every Friday at 2PM ET, during both the pre-season and regular season, previously unlisted drivers will be added to the list of available drivers. Once a driver has been officially listed, he then may be selected during league drafts, and he may be requested by teams via the worst-to-first free agent acquisition process.

    Online Draft
    Once your private league has eight registered teams, the league and draft time are locked. Your draft will be conducted using this pre-determined, random-generated draft order in a snake-order format such that Team 1 picks first, Team 2 picks second, ... Team 8 picks 8th, Team 8 picks 9th, Team 7 picks 10th, Team 6 picks 11th, ... Team 1 picks 16th, Team 1 picks 17th, and so forth through 6 rounds. In each round, you will have up to 60 seconds to draft a driver. The draft order is randomly generated and cannot be changed.

    You may draft your drivers using three available methods via the online draft:
    1. Live driver selection
    2. Draft list selection
    3. Automated selection


    Live Driver Selection
    You may select your driver from the pool of available drivers during your allotted 60 seconds. To make live driver selections, you must be logged on to the website during the time of your draft. Once you have made your live driver selection, the draft proceeds to the next team in the draft order regardless of any time remaining in your 60-second allotment. If you do not complete your selection within 60 seconds, the computer system will select your driver from your draft list, if available, or from the pre-determined ranked list, and will continue to auto-draft your driver each time it is your team's turn to draft. You must turn off the automated drafting in order to resume making live driver selections.

    Draft List Selection
    Prior to and during your league's draft, you may create a draft list of drivers that are ranked in the order that you would like them selected for your team. If you are not logged on to the website during the time of your draft and you have created a draft list, the system will select the next available driver from your draft list that will fill an open position on your starting team. Once your starting team has been filled, the system will select your garage drivers. If your draft list is exhausted, the system will select your driver from the automated list. When drafting from your draft list, the system will select your next driver as soon as it is your team's turn to draft and will not allow the 60 seconds to expire. If you log on during your draft, you must turn off the automated drafting in order to use your allocated 60 seconds and make live draft selections.

    Automated Selection
    If you are not logged on to the website during the time of your draft and you have not created a draft list, the system will select the next available driver from the automated list of default driver rankings. The system will first fill open positions on your starting team with the best available driver. Once your starting team has been filled, the system will select your garage drivers. When drafting from the automated list, the system will select your next driver as soon as it is your team's turn to draft and will not allow the 60 seconds to expire. If you log on during your draft, you must turn off the automated drafting in order to use your allocated 60 seconds and make live draft selections.

    Once the draft has been completed, you will receive an email confirming the rosters of the 8 teams in your league.
  6. MODIFYING YOUR TEAM
    To modify your team, click the appropriate navigational link on the Game website, login using your email address/user ID and password (if you haven't already done so), modify your starting team and garage, as needed, submit the modifications and record the confirmation number you receive for them. There are three types of modifications: (1) roster switch, (2) worst-to-first free agent acquisition, and (3) first-come-first-served free agent acquisition. There are no driver trades between teams.

    Roster switches can be made each week from Tuesday until the official start time of the weekend's race in order to be effective for the race. Once a race starts, including a race start under caution, no additional roster switches will be allowed. In the event that a race starts and then is postponed to another date, regardless of whether or not the laps from the original race date count as official race laps, no additional roster switches will be allowed prior to the re-start of the race.

    Requests for worst-to-first free agent acquisitions must be submitted 48 hours prior to the official TV coverage start time for the race. Worst-to-first free agents are awarded automatically within two hours after the deadline based on the criteria listed below.

    First-come-first-served free agent acquisitions can be made within the 48 hour window prior to the official start time of the race. Drivers that are dropped from other teams in your league during the current week (either for worst-to-first or first-come-first-served free agent acquisitions) and any previously unlisted drivers that are added to the list of available players during the first-come-first-served free agent acquisition period are not available until the following week and must be requested via the worst-to-first free agent acquisition process the following week.

    At the official start time, your team is locked in for the upcoming race. No roster changes are allowed until the following Tuesday at 12:00 p.m. (Noon) ET. Your team carries over from week to week if you do not make any modifications.

    For Race 1, the Daytona 500, the deadline for submitting requests for worst-to-first free agent acquisitions is 48 hours prior to the official race start time, for leagues that have completed their drafts by this time. If your league completes its draft after this time, only first-come-first-served free agent acquisitions are available for the Daytona 500.

    The deadline for roster switches and first-come-first-served free agent acquisitions for the Daytona 500 is on the official TV coverage (listed on http://www.nascar.com/races/cup/2008/data/schedule.html) start time Sunday, February 17.

    Roster Switch

    A roster switch occurs when you replace a driver on your starting team with a driver from your garage. Roster switches are unlimited during the Contest.

    Worst-to-First Free Agent Acquisition
    Worst-to-first free agent acquisitions are available for each race, and occur once you request a driver, and then are awarded the requested driver. Once you are awarded a worst-to-first free agent, he must remain on your roster for at least one race. You may request any driver not on a roster of any team in your league. You must submit a request for a worst-to-first free agent acquisition 48 hours prior to the official TV coverage start time prior to the race start time. The free agent request includes both the driver to add and the driver to drop.

    In a two hour window after the worst-to-first deadline, all worst-to-first free agent acquisition requests for your league are reviewed. Except for Race 1, free agents are awarded in the reverse order of the league's standings through the previous weekend's results such that the worst team is awarded its first choice, then the second worst team is awarded its first choice (provided the driver was not already awarded to the worst team), and so forth through the 8 teams in the league. A second driver is awarded to each team by again using the reverse order of the league's standings, provided that there are requests for drivers who have not been previously awarded. The process continues in this manner until all requested drivers have been awarded. In the event that two or more teams are tied in the standings, the following tie-breaker criteria are used to determine the order of awarding free agents:
    1. Direct head-2-head match-up record. If this doesn't break the tie then,
    2. The team with the fewest number of cumulative points. If that doesn�t break the tie then,
    3. A random draw is used to determine the order of the tied teams.

    For Race 1, free agents are awarded in the reverse order of the league's draft such that the team that drafted 8th is awarded its first choice, then the team that drafted 7th is awarded its first choice, and so forth. For leagues that complete their draft after the 48 hours window prior to the Daytona 500, there are no worst-to-first free agent acquisitions for Race 1.

    Once a worst-to-first free agent request is submitted, the specified driver to be dropped is frozen until after the requested free agents are awarded. You may delete a previously submitted request for a worst-to-first free agent at any time until 48 hour window prior to the official TV coverage start time prior to the race start time. You may not specify to drop a driver from your team who is on the No Drop list. See below for additional information.

    The first deadline for requests for worst-to-first free agent acquisitions is 48 hours prior to the official start time of the Daytona 500, for leagues that have completed their drafts by this time. For leagues that complete their drafts after this time, the first deadline for requests for worst-to-first free agent acquisitions is 48 hours prior to the 2nd race.

    First-Come-First-Served Free Agent Acquisition
    A first-come-first-served free agent acquisition occurs when you add a new driver to your team, and drop a driver from your team after the week's worst-to-first free agent acquisition period ends. First-come-first-served free agent acquisitions are available for each race and can be made starting 46 hours prior to the official TV coverage start time prior to the race start time. First-come-first-served free agents are awarded on a first-come, first-served basis. Once you acquire a first-come-first-served free agent, he must remain on your roster for at least one race. You may acquire any driver that is not on any team in your league and that is not on your league's protected list. Drivers that are dropped from other teams in your league during the current week (either for worst-to-first or first-come-first-served free agent acquisitions) and any previously unlisted drivers that are added to the list of available drivers during the first-come-first-served free agent acquisition period are protected drivers and are not available as first-come-first-served free agent acquisitions. Protected drivers will be available the following week via the worst-to-first free agent acquisition process.

    The driver you drop from your team may not be acquired by any team in your league until the following week according to the worst-to-first free agent acquisition rules described above. You may not drop a driver from your team who is on the No Drop list.
    Once the official TV coverage start time for the race passes, no additional free agent acquisitions will be allowed. In the event that a race starts and then is postponed to another date, regardless of whether or not the laps from the original race date count as official race laps, no additional free agent acquisitions will be allowed prior to the re-start of the race.

    No Drop List
    Each Tuesday beginning Tuesday, February 19, 2008, the Game Administrator will define the No Drop list for the upcoming weekend's race. Drivers on the No Drop list may not be dropped from your team roster as part of a worst-to-first free agent acquisition request and may not be specified to be dropped from your team roster as part of a first-come-first-served free agent acquisition. The No Drop list will consist of the drivers deemed most valuable to teams competing in DRAFT AND PLAY FANTASY NASCAR and is intended to minimize potential collusion amongst team owners in a league.

    Before the Contest begins (until the official TV coverage start time prior to the race start time on Sunday, February 17, 2008), all modifications to your team are subject to the requirements and restrictions listed above.
  7. SCORING.
    To determine league standings, teams are ranked by the total points from the drivers on their starting teams. The team with the most points is first and the team with the fewest points is last. During each race every team will play a match-up against a league opponent. The team with the highest score will score a win. In the event of a tie, the team with the highest cumulative points will win.

    Points are awarded to drivers using the following formula:
    Total Points = Qualifying Points + Sprint Cup Points

    Qualifying Points are awarded to a driver based on his qualifying position where position 1 receives 43 points, Position 2 received 42 points, and so forth to Position 43 which receives 1 point. In the event that drivers do not qualify for a race due to weather or other circumstances and thus the starting order is determined by owner points, Qualifying Points still are awarded based on the starting order.

    Points are accumulated weekly for all 4 starting drivers. Only Qualifying Points and Sprint Cup points from the listed races are used. A driver's Qualifying Points and Sprint Cup points are added to your team totals only during the week(s) that he is on your starting team.

    Final Fantasy Point Scoring. This game will utilize the final “Race Results” scoring for all drivers on the NASCAR.com website for scoring. In the event of penalty points assessed to a driver, the scoring for this game will only reflect the penalty points if penalty is announced by 5pm ET on the Tuesday following the race and the official “Race Results” on the NASCAR.com page are changed to reflectthis penalty. Any penalties assessed that aren’t reflected n Race Results or are made after 5pm ET on the Tuesday following the race will not be used for this game. Any penalties announced that impact overall standings only and are not reflected in the official race results will not be used in this game. Updating of scores on the fantasy site may take a few hours before they are reflected on the team boxscore or standings reports.

    All scoring disputes must be submitted to the Game Administrator at fantasynascar@head2head.com by the Tuesday following the race at 5:00 p.m. ET. All Game Administrator rulings for scoring are final and binding and will be posted on the website within 48 hours of the submission deadline.
  8. PRIZES.
    There are no prizes associated with the Game.
  9. GENERAL RULES AND REGULATIONS. By entering the Game, participants grant Sponsor and its designees the right, without obligation, to use their names, roster names, city and state of residence, score, ranking, voice, pictures and likeness, without compensation, for the purpose of executing the Game and also for the purposes of advertising and publicizing the goods and services of Sponsor and all matters related to the Game in any manner or medium, throughout the world, in perpetuity, unless prohibited by law. Game Entities expressly disclaim any responsibility for, and entrants agree to hold the Game Entities harmless against, liability for injury or loss to any person or property relating to participation in the Game.

    Game Entities and their employees, officers, directors, shareholders, agents, and their respective parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for:
    Late, lost, delayed, damaged, misdirected or incomplete entries;
    Telephone, electronic, hardware, or software program, network, internet, or computer malfunctions, failures, or difficulties; Errors in transmission;
    Any condition caused by events beyond the control of Sponsor that may cause the Game to be disrupted or corrupted;
    Any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use, or misuse of a prize, or from participation in the Game; or
    Any printing or typographical errors in any materials associated with the Game.

    If technical difficulties of any kind compromise the integrity or ability to continue online entry, Sponsor or Game Administrator reserves the right to modify or terminate online entry. If the Season or any Race is delayed, extended, interrupted, cancelled or shortened for any reason, the Game may be postponed, extended, shortened or terminated at the sole discretion of Sponsor. In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsor's control, which corrupt the integrity, administration, security or proper operation of the Game, Sponsor or Game Administrator reserve the right, in their sole discretion, to modify, cancel or suspend the Game. Where the Game has been cancelled prior to stated expiration date, notice will be posted at fantasy.nascar.com.
  10. CONSTRUCTION.
    All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant, Sponsor or Game Administrator, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Georgia. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
  11. THE COMMISSIONER'S OFFICE. An official standards and practices committee called The Commissioner's Office has been established to govern the rules and play of Draft & Play game . You may address any questions, discrepancies, concerns or suggestions to The Commissioner's Office – NASCAR.com, c/o Head2Head Sports, LLC, 8145 E. Evans Road, Suite #3, Scottsdale, AZ 85260, phone (480) 429-8844. The Commissioner's Office reserves the right to adjust any rule if such an adjustment best serves all competitors. The Commissioner's Office also reserves the right to disqualify or refuse service to anyone if there is any evidence of tampering or manipulation.
